Account Activation and Setup
Speed Technologies LTD will setup your account with us once we have received full payment for your order, and this payment has been screened by PayPal for fraud prevention purposes.
In order to provide you with service, you must provide us with the at least the mandatory information, as requested upon sign-up. If we have reason to doubt the validity of the information which you provide to us, your order may be flagged as fraud, and thus cancelled.
Speed Technologies LTD will endeavour to fulfill your order within 12 hours of your full payment being received. While web hosting and SHOUTcast orders should be activated almost instantly, domain name registrations will only be fulfilled after being checked for fraud.
While we will make every effort to fulfill your order in a timely manner, this cannot always be achieved. You agree to indemnify Speed Technologies LTD.

Acceptable Content Policy
All services provided to you by Speed Technologies LTD may only be used within the terms of this policy. Speed Technologies LTD does not allow the following material to be hosted on, streamed to or contained upon it's servers:
- Copyrighted material; of which you are niether licensee nor author;
- Material which can classed as threatening or obscene;
- Internet Relay Chat (IRC) bots;
- Proxy or Anonymizer scripts;
- Warez distribution systems;
- Pirated software distribution systems;
- Hate content;
- Hack programs or archives;
- Material which promotes or advertises illegal, or potentially illegal, activity;
- Adult and pornographic content.
Please be aware that Speed Technologies LTD instigates a zero-tolerance policy with regards to adult and pornographic content. Any customer which has such content on any service provided to them will have such services terminated, without warning or refund.
Any customer which has content on any service provided to them which violates this policy will be issued with a warning, which should be responded to within the timeframe outlined to them. This timeframe will be dependent on the severity of the issue. Should a response not be solicited within this timeframe, the services will be automatically suspended, pending termination if no response is solicited within 7 days of the initial notice.
Speed Technologies LTD do not hold any responsibility for the content streamed or broadcast on it's SHOUTcast servers. The customer shall be held fully responsible for what music is streamed or broadcast; and Speed Technologies LTD will not perform any moderation or proactively check the content being streamed or broadcast. We will cooperate fully with claims of copyright infringement.

Zero Tolerance Spam Policy
Speed Technologies LTD will not tolerate, under any circumstances, the sending of unsolicited e-mail, bulk emailing, or SPAM. It must be clear that the recipient of any email sent by a user is either expecting the email, or has warranted that you send them emails. Any customer who does not follow this policy, will have their services terminated, without warning or refund.
Speed Technologies LTD reserves the right to require changes or to disable as any necessary any web space, account, database or other component which does not comply with this policy, at it's sole discretion. Speed Technologies LTD also reserves the right to make any such modifications in a situation where an immediate response is required.
Any customer which instigates spam, or unsolicited email, will be liable for any damages caused as a result of failing to follow this policy.
You agree to indemnify and hold harmless Speed Technologies LTD for any claims resulting from failure to comply with this policy.

Payment Information
You agree to supply appropriate and full payment for the services which you receive from Speed Technologies LTD, in advance of the time period during which such services will be provided to you. You agree that until, and unless, you notify Speed Technologies LTD of your desire to cancel any such services, as covered by further policies in this document, such services will be requested on a recurring basis.
Speed Technologies LTD will endevour to generate invoices at least 7 days from the due date of the package. Payment can be made any time while the invoice is active, and the payment will only apply to the time period starting from the date when the invoice is due, rather when the invoice is paid.
Speed Technologies LTD reserves the right to change the prices of certain packages or accounts at any time, without any notification, should this be deemed necessary.
Speed Technologies LTD reserves the right to suspend any account whose services have not been paid after 72 hours from the payment due date. due date

Late Fees
Any invoice which is not paid within 72 hours from the payment due date will be liable to pay a 5% late charge, on the total amount due on the invoice. This late charge will become included within the invoice, to be paid in full with it.
Late fees are not refundable, and cannot be transferred to any other invoice other than the one to which they apply.

Back-ups and Data Loss
Speed Technologies LTD is not responsible for the files and data residing on your account. You agree to take full responsibility for the files and data transferred and to maintain any backups as you see fit and appropriate. While Speed Technologies LTD may take server backups, these should not be relied upon for restoration in the event of data loss (that is, in the event where files and data become unavailable, corrupt or are deleted). If required, Speed Technologies LTD may be able to provision a backup from our weekly backup routine. A nominal charge will be applied for this service, as we see appropriate.
Speed Technologies LTD should be indemnified and held harmless from any loss of business, sales or uptime arising as a result of using our services.

Force Majeure
Speed Technologies LTD cannot be held liable for any failure to provision or provide appropriately any services, where any such failure is as a result of an Act of Nature (including flood, fire, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war has been declared or not), civil war, rebellion, revolution, insurrection, military or usurped power of confiscation, terrorist activities, nationalism, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or server or staff internet connectivity.

Cancellations and Refunds
Speed Technologies LTD operates a 15-day money-back guarantee policy. We will provide a full refund for all products (excluding all domain name registrations, renewals or transfers) if you are dissatisfied or have otherwise changed your mind. A request for the refund must be received with 15 clear days, otherwise your refund request will be at the discretion of Speed Technologies LTD management. This policy applies to the 15 clear days after the first payment for a specific service, and not to any subsequent payments for that service.
All cancellations must be received at least 5 working days prior to an accounts renewal date. You will be expected to pay for any outstanding invoices, if these are generated. Speed Technologies LTD reserves the right to take appropriate action to recover funds which are outstanding on an account for a period longer than 30 days after the due date.

Resource Usage
Customers may not:
- use 25% or more of system resources for longer than 90 seconds in a given 24 hour period.
- run any type of interactive real-time chat application which uses more than 15% of system resources at any given time.
- run standalone, unattended server-side processes at any given time. This includes all daemons, such as IRCD.
- run any software which interfaces with an Internet Relay Chat (IRC) network.
Any customer which fails to adhere to this policy will have their account suspended immediately, and any related processes killed.

Bandwidth and Disk Space Allocations
You are alllocated monthly bandwidth and disk space quotas. These quotas vary depending on the package which you have selected for your account. Your account will be automatically blocked from going over any limits, and you must contact Support to request more resources, for your account to continue to function
This is subject to additional charges, which will be at the sole descretion of Speed Technologies LTD.
You agree to indemnify and hold harmless Speed Technologies LTD for any claims arising from the failure to have appropriate usage capacities.

Price Change
The amount which you pay for hosting will not increase from the date of purchase, unless you elect to have your package changed or modified. We reserve the right to increase the amount of resources given to plans or packages at any time, and to change the prices of any such plans or packages.

Special Offers
SpeedHosting reserves the right to add or remove any special offer without warning at any given time.

Guaranteed Service Level (Service Level Agreements)
Speed Technologies LTD operates two service-level agreements; a standard agreement, and an extended agreement. The service-level agreement your account will be handled on will be made clear to you before signing up for your account. If this is not the case, then you should assume that the standard service-level agreement is in effect. This applies to accounts which were registered before we changed our support policy to include two service-level agreements.
Standard
- if your service is not available for at least 99.0% of the month, you will be credited with 20% of that months bill. If availablity falls below 96.0%, you will be creditted with 40% of that months bill. "Available" refers to your service being accessible by third-party users, and does not include periods of unavailablity deemed necessary by other sections of this agreement (such as suspensions, etc).
- if your service is not available for at least 99.9% of the month, you will be credited with 10% of that months bill. If availablity falls below 99.0%, you will be creditted with 40% of that months bill. This will increase to 100% of your bill, should availablity fall below 95.0% of the month. "Available" refers to your service being accessible by third-party users, and does not include periods of unavailablity deemed necessary by other sections of this agreement (such as suspensions, etc).

Disclaimer
Speed Technologies LTD will not be responsible for any damages of any kind that you or your business may suffer as a result of using our services. This includes, but is not limited to; loss of data, interruptions to service, loss of business. Speed Technologies LTD will make every effort to keep service interruption to a minimum, as is within our control.
Speed Technologies LTD maintains a responsibility to protect the interests of our customer base as a whole, and we will take action to ensure that the integrity of our services is maintained. Legal action will be taken against those who are found to be actively seeking to damage our brand, our property or our services.
You agree to indemnify and hold harmless Speed Technologies LTD for any such claims.

Cease
Speed Technologies LTD reserve the right to cancel or terminate any account at any time where we see fit.

Modifications to the Terms of Service agreement
Speed Technologies LTD reserve the right to revise or modify it's policies at any time, without notice, except where a significant departure is made from the original policy, and the new policy, when all customers will be notified of the changes within reason.
